Terms and Conditions

These Terms and Conditions govern your use of The Online Gun Show website, where qualified independent sellers list and sell, and any products OGS may offer for sale directly from time to time. They describe order cancellation, final-sale policies for regulated items, payment disputes, returns, and how disagreements are resolved. Please read them carefully before placing an order.

Important Notice Regarding Final Sales, Transfers, and Payment Disputes

By placing an order, you agree to OGS's cancellation, return, payment-dispute, and dispute-resolution policies. Once an item has been fulfilled, shipped, transferred through a licensed FFL dealer where applicable, or accepted by you, certain sales are final as described below. If you believe there is an issue with your order, you agree to contact OGS first so we can review and attempt to resolve the issue. Nothing in these Terms limits any non-waivable rights you may have under applicable law.

Agreement to Terms

By accessing or using this website (theonlinegunshow.com) and/or placing an order through The Online Gun Show ("OGS", "we", "us", or "our"), you ("Buyer", "you", or "your") acknowledge that you have read, understood, and agree to be legally bound by these Store Policies (Terms and Conditions), including all future amendments.

The Online Gun Show is operated by Southern Iron Holdings LLC.

These Terms constitute a legally binding agreement between you and Southern Iron Holdings LLC dba The Online Gun Show. Our Privacy Policy describes how we collect and use personal information. If you do not agree to these Terms, you must not use this website or place any orders.

OGS Store and Independent Sellers

The Online Gun Show is a platform where qualified independent sellers may list and sell. When you purchase from an independent seller, that seller is the seller of record and processes your payment through the seller's own payment processor. Independent sellers pay OGS a platform fee.

OGS does not collect, hold, or remit payments on behalf of independent sellers. Independent sellers are responsible for their listings, fulfillment, FFL compliance, refunds, and payment disputes on their own sales.

OGS may offer products for sale directly from time to time. Our third-party payment processor handles platform fees billed to sellers and any direct sales by OGS.

Order Cancellation Fees

You acknowledge and agree that OGS incurs real costs and invests significant time in processing every order from the moment it is placed. Therefore, the following cancellation policy applies:

All cancellation requests must be submitted in writing via email to info@theonlinegunshow.com and are subject to written confirmation from OGS. Cancellations are not effective until confirmed in writing.

All Sales Final After Fulfillment or Transfer

Firearms, serialized receivers, suppressors and other NFA items, and ammunition are final once shipped, transferred through a licensed FFL dealer where applicable, or accepted by you.

  • Where possible, you should inspect items before completing an FFL transfer or taking possession.
  • Completing an FFL transfer or taking possession constitutes acceptance of the item's delivered condition, except for rights that cannot be waived by applicable law.
  • Buyer's-remorse, change-of-mind, or similar post-fulfillment disputes do not override this policy where permitted by law.

Non-firearm items that have been opened, installed, or used are also non-returnable, subject to Section 9.

Chargebacks, Payment Disputes & Fraudulent Transactions

If you believe there is an unauthorized charge, billing error, non-delivery issue, duplicate charge, or other payment problem, you should contact OGS promptly at info@theonlinegunshow.com so we can investigate and attempt to resolve the matter.

After an order has been fulfilled, shipped, transferred through a licensed FFL dealer where applicable, or accepted by you, you agree not to initiate a false, bad-faith, duplicate, or buyer's-remorse chargeback or payment dispute for an item that was delivered, transferred, or accepted according to these Terms.

If you initiate a chargeback or payment dispute that is inconsistent with these Terms, OGS may provide the payment processor, card issuer, bank, or other applicable party with evidence related to the transaction, including order records, shipment confirmation, FFL transfer documentation, delivery confirmation, customer communications, and your acceptance of these Terms.

To the extent permitted by applicable law and payment-network rules, you agree that you may be responsible for the original order amount, unrecovered shipping costs, processor chargeback fees, reasonable administrative costs, collection costs, and reasonable attorney's fees arising from a false, bad-faith, or improper post-fulfillment chargeback.

OGS may suspend or terminate accounts associated with fraudulent, abusive, or bad-faith payment disputes. Where OGS reasonably suspects fraud or illegal conduct, OGS may report the matter to appropriate authorities.

Nothing in this section limits any rights you may have under applicable law, including rights related to unauthorized charges, billing errors, non-delivery, or other non-waivable payment-dispute rights.

Buyer Inspection Requirement

You agree to thoroughly inspect all items immediately upon receipt or upon completion of the FFL transfer process, where applicable.

Any claim regarding damage, defect, missing parts, or "not as described" must be submitted to OGS in writing within 48 hours of receipt or transfer, accompanied by clear photographic evidence. Failure to report issues within this timeframe may be treated as acceptance of the item in its delivered condition, except for rights that cannot be waived by applicable law.

Firearms, FFL Transfers & Legal Compliance

You are solely responsible for ensuring that you are legally eligible to purchase and possess all items ordered under applicable federal, state, and local laws. By placing an order, you represent and warrant that:

  • You are of legal age to purchase the items ordered;
  • You are not prohibited by law from purchasing, possessing, or receiving the items;
  • You are purchasing the items for your own lawful use and not for resale in violation of any law;
  • All information you provide (including billing/shipping details and FFL information) is accurate and complete.

For all firearm purchases, you must select a valid licensed FFL dealer who will accept the transfer. You are responsible for all FFL transfer fees, background check fees, and any other costs associated with the transfer. OGS is not responsible if your chosen FFL refuses or is unable to accept the transfer for any reason.

Orders for firearms will not be shipped until OGS has received a valid copy of your chosen FFL's license. Failure to provide a matching FFL copy within the requested timeframe may result in order cancellation and applicable fees.

Buyer Responsibilities & Representations

By placing an order, you represent, warrant, and agree that:

  • You will comply with all applicable federal, state, and local laws regarding the purchase, possession, transportation, and use of the items ordered;
  • You are purchasing the items for lawful purposes only;
  • You will not use any item purchased in any manner that violates any law;
  • You accept full responsibility for ensuring the items are legal in your jurisdiction before ordering;
  • You will not hold OGS or its sellers liable for any legal consequences arising from your purchase, possession, or use of the items.

Returns, Restocking Fees & Refunds

Firearms, serialized items, suppressors and other NFA items, and ammunition remain non-returnable after fulfillment, transfer, or acceptance, as described in Section 4.

Non-firearm accessories may be returnable only if unopened, unused, and approved through a Return Merchandise Authorization (RMA) from OGS within 30 days of delivery, where permitted by law.

Approved accessory returns may be subject to a 20% restocking fee plus original and return shipping costs, where permitted by law. Returns must include the issued RMA number and be shipped in original, resalable condition with all packaging and documentation.

No returns will be accepted for opened, used, installed, or customized items.

Warranty & Product Information

All warranties, if any, are provided exclusively by the manufacturer. OGS does not provide any express or implied warranties on any products sold.

Product images, descriptions, and specifications are provided for reference only and may not be entirely accurate. You are responsible for verifying all product details with the manufacturer before purchase. OGS is not responsible for discrepancies between product images/descriptions and the actual item received.

Limitation of Liability & Indemnification

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OGS AND INDEPENDENT SELLERS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.

You agree to indemnify, defend, and hold harmless OGS, its owners, officers, directors, employees, agents, and independent sellers from and against any and all claims, damages, obligations, losses, liabilities, costs, and expenses (including reasonable attorney's fees) arising from:

  • Your use of the website or purchase of any item;
  • Your violation of these Terms;
  • Your violation of any third-party right;
  • Any claim that your use of an item caused damage to a third party.

Dispute Resolution & Arbitration

Informal Resolution First

Before filing a lawsuit or arbitration, you and OGS agree to first attempt to resolve the dispute informally. A party seeking to raise a dispute must send written notice describing the dispute and requested relief to info@theonlinegunshow.com. The parties will have 30 days to attempt to resolve the dispute informally unless urgent relief is needed.

Binding Individual Arbitration

Except for disputes that qualify for small claims court or requests for temporary or injunctive relief, any dispute, claim, or controversy arising out of or relating to these Terms, the website, an order, a listing, a payment, or any transaction with OGS will be resolved by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, unless another arbitration provider is required by applicable law or agreed by the parties.

Federal Arbitration Act

The parties agree that this arbitration agreement involves interstate commerce and is governed by the Federal Arbitration Act.

No Class Actions

You and OGS agree that disputes will be resolved only on an individual basis. Neither party may bring or participate in a class action, class arbitration, private attorney general action, or other representative proceeding to the extent permitted by law.

Jury Trial Waiver

To the extent any dispute proceeds in court rather than arbitration, you and OGS knowingly waive the right to a jury trial.

Small Claims and Equitable Relief

Either party may bring an individual claim in small claims court if the claim qualifies. Either party may also seek temporary, preliminary, or injunctive relief in a court of competent jurisdiction where necessary to protect intellectual property, confidential information, account security, payment integrity, regulatory compliance, or to prevent immediate harm.

Location and Format

Arbitration may be conducted by video, telephone, written submissions, or another format permitted by the applicable arbitration rules. Any in-person hearing will be conducted in a location consistent with the applicable arbitration rules and applicable law.

Fees

Arbitration fees and costs will be allocated according to the applicable arbitration provider's consumer rules and applicable law.

Severability

If any part of this arbitration agreement is found unenforceable, the remaining provisions will remain in effect to the fullest extent permitted by law. If the class-action waiver is found unenforceable as to a particular claim, that claim must proceed in court and not in arbitration unless the parties agree otherwise.

Miscellaneous Provisions

Governing Law: These Terms shall be governed by and construed in accordance with the laws of the State of Alabama, without regard to its conflict of laws principles.

Severability: If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.

Entire Agreement: These Terms, together with any policies referenced herein, constitute the entire agreement between you and OGS regarding your use of the website and purchase of products.

Changes to Terms: OGS reserves the right to modify these Terms at any time. Changes will be effective upon posting to the website. Your continued use of the site or placement of orders after changes constitutes acceptance of the revised Terms.
